Terms of Service

1. The Service

Orlea is a macOS and web application that lets you save links, notes, files, and other content into organized boards. The Service includes the Orlea desktop application, web application, browser extension, and any related APIs.

2. Eligibility

You must be at least 13 years old to use Orlea. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. If you become aware of unauthorized access, notify us immediately at support@orlea.app.

4. Your Content

You retain ownership of all content you save to Orlea (“Your Content”). By using the Service, you grant us a limited license to store, display, and process Your Content solely to provide the Service to you. We do not claim ownership of Your Content and will not use it for any purpose other than operating the Service.

You are responsible for ensuring you have the right to save and store any content you add to Orlea. We are not responsible for the content of third-party websites you link to or save.

5. Acceptable Use

You agree not to use Orlea to:

• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Upload malware, viruses, or other harmful code
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service for other users
• Use the Service for spam, phishing, or other deceptive practices
• Scrape, crawl, or otherwise extract data from the Service through automated means without our written permission

We may suspend or terminate your account if we reasonably believe you are violating these terms.

6. Public Boards

Orlea allows you to make boards publicly accessible. When you publish a board, its contents are visible to anyone with the link and may be indexed by search engines. You are solely responsible for any content you choose to make public. Boards are private by default.

7. Intellectual Property

The Service, including its design, code, logos, and documentation, is owned by Agentica, LLC and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use the Orlea or Agentica name, logos, or branding without our prior written consent.

8. Availability and Changes

We strive to keep Orlea available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of material changes in advance.

9. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be secure, error-free, or available at all times.

11. Limitation of Liability

To the maximum extent permitted by law, Agentica, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Agentica, LLC and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney’s fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice in the Service at least 30 days before the changes take effect. Your continued use of Orlea after the effective date constitutes acceptance of the updated Terms.
